PRIVACY AND IP POLICY

According to the applicable regulations, ILION hereby informs the USER of the following issues:

Spanish Organic Law 15/1999 of 13 December on the Protection of Personal Data and to the General Data EU Regulation, as well as to Spanish Act 34/2002 on Information Society Services and Electronic Commerce, ILIONSTUDIOS, S.A. (“ILION”), with tax identification number A83467910 and address for notification purposes at Complejo Europa empresarial, C/ Rozabella, 4, Edificio Bruselas, Las Rozas, 28290 Madrid; hereby informs of its Data Protection Policy to the users (“USERS”) of ILION´s web page accessible through the domain name www.ilion.com (the “Web Site”):

ILION does not collect any data from USERS unless they voluntarily request or submit any information through the sections “Contact” or “Send your CV”of the Web Page or unless they consent to cookies in the terms foreseen herein.

A. “Contact” sections of the web page

(i) Personal Data Filing System

The personal data collected through the emails sent to the different addresses included in the “Contact” sections of the Web Site (the “Personal Data”) will be treated confidentially and with the sole purpose of providing the USER with the requested information and/or of responding to the request or query filed by the own USER. The data collected or generated or requested by ILION as a consequence of the exchange of emails between the USER and ILION will be included in a filing system under the responsibility of ILION.

(ii) Purpose and basis of the processing

ILION shall process the USER´s Personal Data for the sole purpose of providing the USER with the requested information and/or of responding to the request or query filed by the own USER.

The legitimate basis for the processing of USER´s Personal Data is the USER´s own initiative to send a question/query/request to ILION and ILION´s wish to respond to such initiative. ILION reserves the right not to respond to messages sent to the contact emails, at its own free discretion.

(iii) Compulsory or optional nature of the requested information

ILION does not require any compulsory information. It is the USER´s discretion to provide contact data for ILION to be able to respond the query or request. The information provided by the USER in the contact emails is the information that the USER has freely decided to include; ILION does not require any information to be included or disclosed. ILION urges USERS not to include sensitive information in their requests and to only disclose to ILION the information necessary to solve their query.

In case the USER intends to provide his CV and/or demo-reel, he is requested to upload it through the “Send us your CV” section of the web site and not send it through the Contact emails.

The denial to provide the contact information, the withdrawal of the consent given or the exercise of the rights of erasure, objection or restriction of the processing could impair ILION from responding to the USER´s request or query.

(iv) Data Protection Officer

ILION has appointed the Head of the Legal Department as Data Protection Officer, with contact email legal@ilion.com.

(v) Special categories of data

ILION does not require any special categories of data. Regardless of the foregoing, the USER provides ILION with the information it wishes, freely, under the USER´s own responsibility. ILION urges the USER not to provide sensitive or delicate information through the “Contact” emails.

In case the USER intends to provide his CV and/or demo-reel, he is requested to upload it through the “Send us your CV” section of the web site and not send it through the Contact emails.

(vi) International transfer of data

Microsoft Corporation´s Office 365 and Azure applications collect, store and manage ILION´s email system, which could include USERS information. Microsoft stores and hosts such information in servers physically located in the US and other territories (for more information: https://privacy.microsoft.com/es-es/privacystatement). The Spanish Data Protection Agency has declared that such international transfer to Microsoft´s systems offers sufficient guarantees and that it therefore is a lawful and permitted international transfer (resolution of the Spanish Data Protection Agency of May 9th, 2014).

(vii) Exercise of Rights

The USER can exercise his/her rights of access, rectification, erasure, objection, restriction of processing and data portability by notice in writing to the ILION´s Data Protection Officer by writing an email to legal@ilion.com including the following information: (a) Name, surname and copy of his/her identification card or equivalent document (and, if acting on behalf of another person, the appropriate authorization in this regard); (b) Purpose of the request; (c) Address for notification and (d) Date and scanned signature of the USER.

The USER shall have the right to withdraw his or her consent at any time, by written notification as per the above. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. The foregoing shall be without prejudice of section (iii) with regards to compulsory data.

If USER considers that his/her data have been treated inappropriately, the USER can exercise his/her right to file a claim with Agencia Española de protección de Datos (C/ Jorge Juan, 6. 28001 – Madrid www.agpd.es).

(viii) Commitments of the USER regarding data protection

THE USER undertakes to:

Provide current, accurate and truthful information. Inform ILION about any changes in the information provided, through the procedure foreseen above for the exercise of the right of rectification.

Comply with his/her obligation of secrecy regarding all personal data and confidential information to which he/she has access because of his/her exchange of emails with ILION, obligation that has an indefinite duration.

(ix) Maintenance in time of USER’s Personal Data

ILION shall keep USER´s Personal Data for as long as it is necessary to solve the USER´s request or query, and for any time necessary to solve any civil or other kind of responsibility, if any.

(x) Security measures

ILION has undertaken the technical and organizational measures necessary to ensure the security of personal data and to avoid their alteration, loss, unauthorized access or processing, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, either from human action or from the physical or natural environment.

(xi) ILION´s internal data protection protocol

ILION and all its employees and other personnel that process personal data are ruled by ILION´s internal data protection protocol, which sets out in detail the rules that must be complied with when processing personal data, as well as the security measures adopted regarding such data.

(xii) Intellectual Property Policy

Please don’t send nor submit to ILION through the email addresses of the Contact sections of the web site nor in any other way, any idea, work, story, treatment, concept, bible, script, graphic work, artwork, music, software code or other creative material or information, as ILION does not accept unsolicited submissions.

If, in violation of the above, you submit in any way any material to ILION, such submission shall in no event subject ILION to any obligation of any kind, either express or implied, including, without limitation, confidentiality, attribution, compensation, review, production or otherwise, and ILION shall not be liable for any exploitation, use, or disclosure of any such submitted material. You hereby agree that no confidential or fiduciary relationship is intended or created by reason of the submission of any unsolicited submission by you, and that you have no expectation of any review, compensation or consideration of any type. You hereby release ILION or its related entities, to the maximum extent allowable by law, of and from, and irrevocably waive, any and all claims, costs, demands, liabilities, fees, penalties and other expenses of any kind whatsoever, known or unknown, that may exist or arise relating to, arising out of, or in connection with any such materials, and/or ILION’s or its related entities’ use or disclosure of the same.

(xiii) Agreement of the USER

The USER, by sending an email to the email addresses included in the Contact section of the Web Site declares and acknowledges to have read and understood this PRIVACY AND IP POLICY and expressly consents to the content therein.

B. “SEND YOUR CV” section of the web page

(i) Controller of the Filing System

ILIONSTUDIOS, S.A., with office for notification purposes at Complejo Europa Empresarial, C/ Rozabella 4, Edificio Bruselas, 28230 Las Rozas, Madrid (Spain) (hereinafter “ILION”, or the “Studio”), hereby informs the CANDIDATE that any personal data specified in his/her curriculum vitae, cover letter, demo reel or portfolio delivered to ILION, the personal data provided by the CANDIDATE in the electronic form in the candidate’s section of the web page accessible through the domain name www.ilion.com, or any other data generated or requested during a potential interview (the Personal Data), will be included in a filing system under the responsibility of ILION.

(ii) Purpose and basis of the processing

ILION shall process the CANDIDATE´s Personal Data for the sole purpose of managing his/her candidacy in present or future selection processes at ILION or at any of the companies belonging to the same corporate group as ILION.

The legitimate basis for the processing of CANDIDATE´s Personal Data is the participation of the CANDIDATE in ILION´s selection processes.

(iii) Assignees of Personal Data

Entities belonging to the same group of companies as ILION, all of which carry out activities that are similar or related to the activities performed by ILION, for the sole purpose of managing the CANDIDATE’s candidacy in present or future selection processes in such group companies.

(iv) Compulsory or optional nature of the requested information

The Data that are compulsory will be identified as such at the moment they are requested.

The denial to provide that information, the withdrawal of the consent given  or the exercise of the rights of erasure, objection or restriction of the processing could impair the proper development of the selection process, which could lead to rejection of the CANDIDATE.

(v) Data Protection Officer

ILION has appointed the Head of the Legal Department at any given time as Data Protection Officer, with contact email legal@ilion.com.

(vi) Special categories of data

ILION does not require any special categories of data. Regardless of the foregoing, the CANDIDATE provides to ILION the information it wishes, freely, in the CV´s, demo reels, etc., under the CANDIDATE´s own responsibility. ILION urges the CANDIDATE not to provide sensitive or delicate information that is not necessary for the selection process.

(vii) International transfer of data

Microsoft Corporation´s Office 365 and Azure applications collect, store and manage the filing system of candidates´ information. Microsoft stores and hosts such information in servers physically located in the US and other territories (for more information: https://privacy.microsoft.com/es-es/privacystatement). THE CANDIDATE can exercise his/her rights of access, rectification, erasure, objection, restriction of processing and data portability by notice in writing to the ILION´s Data Protection Officer by writing an email to legal@ilion.com, identifying him/herself as a candidate to a selection process at ILION, and providing the following information: (i) Name, surname; (ii) Copy of his/her identification card or equivalent document (and, if acting on behalf of another person, the appropriate authorization in this regard); (iii) Purpose of the request; (iv) Address for notification and (v) Date and scanned signature of the CANDIDATE.

The CANDIDATE shall have the right to withdraw his or her consent at any time, by written notification as per the above. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. The foregoing shall be without prejudice of section IV with regards to compulsory data.

If CANDIDATE considers that his/her data have been treated inappropriately, the CANDIDATE can exercise his/her right to file a claim with Agencia Española de protección de Datos (C/ Jorge Juan, 6. 28001 – Madrid www.agpd.es).

(ix) Commitments of the CANDIDATE regarding data protection

THE CANDIDATE undertakes to:

Inform ILION about any changes in the information provided, through the procedure foreseen above for the exercise of the right of rectification.

Comply with his/her obligation of secrecy regarding all personal data and confidential information to which he has access because of his/her participation in the selection process, obligation that shall persist even after such process is finalized, regardless of whether the CANDIDATE has been selected or no.

(x) Maintenance in time of CANDIDATE’s Personal Data

In case the CANDIDATE is not selected for the position he/she applied for, ILION shall keep his/her data in case his/her candidacy was interesting for future selection processes, for a period of five (5) years.

If the CANDIDATE does not wish that his/her data are maintained, he/she can exercise his/her right of erasure through the procedure foreseen above.

Before the period of five years elapses, ILION will be entitled to contact the CANDIDATE to request an update of his/her Personal Data and the renewal of his/her consent to keep his/her data for another five years.

(xi) Security measures

ILION has undertaken the technical and organizational measures necessary to ensure the security of personal data and to avoid their alteration, loss, unauthorized access or processing, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, either from human action or from the physical or natural environment.

The CANDIDATE acknowledges and accepts that no submission of any material shall subject ILION to any obligation of any kind, either express or implied, including without limitation, confidentiality, attribution, compensation, production or otherwise, and ILION shall not be liable for any exploitation, use, or disclosure of any such submitted material. The CANDIDATE hereby releases ILION or its related entities, to the maximum extent allowable by law, of and from, and irrevocably waive, any and all claims, costs, demands, liabilities, fees, penalties and other expenses of any kind whatsoever, known or unknown, that may exist or arise relating to, arising out of, or in connection with any such materials, and/or ILION’s use or disclosure of the same.

(iv) Agreement of the CANDIDATE

The CANDIDATE declares and acknowledges to have read and understood this PRIVACY AND IP POLICY and expressly consents to the content therein.

C. Cookies Policy

The User agrees to the use of cookies and tracking files that our website uses, through the service of Google Analytics. We place cookies to measure and analyze the site´s users behavior. The data obtained will be treated by Google according to Google Analytics Privacy Policy, available here.

Ilion has access to some of those data for the purpose of providing and improving our web services, as well as to measuring, analyzing and personalizing the visits to the website.

Cookies will not be set up on your computer unless and until you consent to their being installed and used by clicking on the “I accept” button.

Additionally, the User accepts the use of cookies and of files tracking IP addresses in order to enable Ilion to collect data for statistical purposes, such as date of first visit, number of times you have visited, date of last visit, URL and domain you have come from, browser used and screen resolution. The information collected is totally anonymous, and in no event can it be associated to a particular and identified user.

In any event, the User may prevent the installation of cookies or delete the ones that already had been installed, through the configuration of the User´s browser, as well as through the use of specific applications. However, disabling cookies may impair the normal functioning of the web site, not being Ilion responsible of this fact.
