Privacy and IP Policy for Candidates

In accordance with the Organic Law 3/2018, of December 5, for the Protection of Personal Data and guarantee of digital rights and with the General Data Protection Regulation (EU) 2016/679, ILIONSTUDIOS, S.A. hereby informs CANDIDATES who wish to submit their curriculum or demo reel to the Studio, about ILION’s Privacy and IP Policy for Candidates:

I.- Controller of the Filing System

ILIONSTUDIOS, S.A., with office for notification purposes at Complejo Europa Empresarial, C/ Rozabella 4, Edificio Bruselas, 28290 Las Rozas, Madrid (Spain) (hereinafter “ILION”, or the “Studio”), hereby informs the CANDIDATE that any personal data specified in his/her curriculum vitae, cover letter, demo reel or portfolio delivered to ILION, the personal data provided by the CANDIDATE in the electronic form in the candidate’s section of the web page accessible through the domain name, , or any other data generated or requested during a potential interview (the Personal Data), will be included in a filing system under the responsibility of ILION.

II.- Purpose and basis of the processing

ILION shall process the CANDIDATE´s Personal Data for the sole purpose of managing his/her candidacy in present or future selection processes at ILION or at any of the companies belonging to the same corporate group as ILION.

The legitimate basis for the processing of CANDIDATE´s Personal Data is the participation of the CANDIDATE in ILION´s selection processes.

III.- Assignees of Personal Data

Entities belonging to the same group of companies as ILION, all of which carry out activities that are similar or related to the activities performed by ILION, for the sole purpose of managing the CANDIDATE’s candidacy in present or future selection processes in such group companies.

IV.- Compulsory or optional nature of the requested information

The Data that is compulsory will be identified as such at the moment it is requested.

The denial to provide that information, the withdrawal of the consent given or the exercise of the rights of erasure, objection or restriction of the processing could impair the proper development of the selection process, which could lead to rejection of the CANDIDATE.

VI.- Special categories of data

ILION does not require any special categories of data. Regardless of the foregoing, the CANDIDATE provides to ILION the information it wishes, freely, in the CV´s, demo reels, etc., under the CANDIDATE´s own responsibility. ILION urges the CANDIDATE not to provide sensitive or delicate information that is not necessary for the selection process.

VII.- International transfer of data

Microsoft Corporation´s Office 365 and Azure applications collect, store and manage the filing system of candidates´ information. Microsoft stores and hosts such information in servers physically located in the US and other territories (for more information: The Spanish Data Protection Agency has declared that such international transfer to Microsoft´s systems offers sufficient guarantees and that it therefore is a lawful and permitted international transfer (resolution of the Spanish Data Protection Agency of May 9th, 2014).

VIII.- Exercise of Rights

THE CANDIDATE can exercise his/her rights of access, rectification, erasure, objection, restriction of processing and data portability by notice in writing to the ILION´s Data Protection Officer by writing an email to; identifying him/herself as a candidate to a selection process at ILION, providing a copy of his/her National Identification Card/passport or an equivalent document, and being specific about his/her request.

The CANDIDATE shall have the right to withdraw his or her consent at any time, by written notification as per the above. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. The foregoing shall be without prejudice of section IV with regards to compulsory data.

If CANDIDATE considers that his/her data have been processed inappropriately, the CANDIDATE can exercise his/her right to file a claim with the Spanish Data Protection Agency (C/ Jorge Juan, 6. 28001 –

IX.- Commitments of the CANDIDATE regarding data protection

THE CANDIDATE undertakes to:

Provide current, accurate and truthful information.
Inform ILION about any changes in the information provided, through the procedure foreseen above for the exercise of the right of rectification.

Comply with his/her obligation of secrecy regarding all personal data and confidential information to which he has access because of his/her participation in the selection process, obligation that shall persist even after such process is finalized, regardless of whether the CANDIDATE has been selected or no.

X.- Maintenance in time of CANDIDATE’s Personal Data

In case the CANDIDATE is not selected for the position he/she applied for, ILION shall keep his/her data in case his/her candidacy was interesting for future selection processes, for a period of five (5) years.

If the CANDIDATE does not wish that his/her data are maintained, he/she can exercise his/her right of erasure through the procedure foreseen above.

Before the period of five (5) years elapses, ILION will be entitled to contact the CANDIDATE to request an update of his/her Personal Data and the renewal of his/her consent to keep his/her data for another five years.

XI.- Security measures

ILION has undertaken the technical and organizational measures necessary to ensure the security of personal data and to avoid their alteration, loss, unauthorized access or processing, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, either from human action or from the physical or natural environment.

XII.- ILION´s internal data protection protocol

ILION and all its employees and other personnel that process personal data are ruled by ILION´s internal data protection protocol, which sets out in detail the rules that must be complied with when processing personal data, as well as the security measures adopted regarding such data.

XIII.- Intellectual Property Policy

In case the CANDIDATE submits to ILION a demo-reel or a curriculum that includes any creative material of any kind, the CANDIDATE must make sure he/she includes only material that has been published and is available to the general public, and that has been authorized by its respective copyright owner.

The CANDIDATE acknowledges and accepts that no submission of any material in a demo-reel or curriculum shall subject ILION to any obligation of any kind, either express or implied, including without limitation, confidentiality, attribution, compensation, production or otherwise, and ILION shall not be liable for any exploitation, use, or disclosure of any such submitted material. The CANDIDATE hereby releases ILION or its related entities, to the maximum extent allowable by law, of and from, and irrevocably waive, any and all claims, costs, demands, liabilities, fees, penalties and other expenses of any kind whatsoever, known or unknown, that may exist or arise relating to, arising out of, or in connection with any such materials, and/or ILION’s use or disclosure of the same.

XIV.- Agreement of the CANDIDATE

The CANDIDATE declares and acknowledges to have read and understood this PRIVACY AND IP POLICY and expressly consents to the content therein.
